Being pulled over for a DUI can have serious repercussions, many of which could shape your life for years to come. Unfortunately, many drivers make simple mistakes, giving up valuable rights and making it easier for prosecutors to build a case against them. Ibold & O'Brien, a criminal defense firm in Chardon, OH, has some tips on what you should do when you’ve been pulled over and what you should avoid.

Do:

Refuse to answer questions.

When pulled over for suspicion of driving under the influence, your only obligation is to identify yourself and get out of the vehicle when asked. Remember that any questions the officer may ask are intended to establish probable cause for an arrest, even if they sound conversational.

Hire an attorney.

If the officer places you under arrest, contact a criminal defense lawyer immediately. They will ensure that the arresting officers follow established protocol, and will work to protect your rights throughout the process, from interrogation to your trial, if necessary.

Don’t:

Speak to police without your attorney.

criminal defenseIf you ask for a criminal defense attorney but continue talking with police, anything you say can still be used against you. Politely but firmly invoke your right to counsel, then refuse to communicate further until they arrive.

Take field sobriety tests.

While you are required to take chemical tests under the implied consent laws of Ohio, this doesn’t extend to field sobriety tests. If the officer asks you to stand on one foot or take a preliminary breath test, they’ve likely already decided to place you under arrest, so there is no benefit to providing them with additional evidence.
