Ask the Right Questions

If an accident has occurred during work hours and/or using a work vehicle, it is imperative to follow a checklist within the first 48 hours following the accident to avoid negative recourse toward your business. Part of this might be conducting a DOT test. First, there are three questions to ask:

  • Was the driver operating a vehicle that required a commercial drivers license (CDL)?
  • Does the accident meet the Federal Motor Carrier Safety Administration’s definition of an accident? 

Conduct Drug & Alcohol Testing, if Necessary

alcohol testingIf the answer to the two previous questions was no, then no drug and alcohol testing is necessary. However, if the answer to both questions is yes, then testing is necessary. The question following those answers should be: Was there a fatality? If yes, testing is required. If the driver was cited or received a ticket, testing is also required. Testing must be completed in the two hours following the accident. The alcohol test must be completed within eight hours after the accident, and the drug test within 32 hours following the accident. Once the windows have closed, the driver is no longer required to be tested.
