Maybe.  Under Ohio law, you are only entitled to a rental car if your car is not a total loss and is repairable.  The wrongdoer's insurance company is obligated to provide you with a similar type vehicle during the time your vehicle is being repaired.

If, however, your car is deemed a total loss, Ohio law does not require the wrongdoer's insurance company to provide a rental.  The law unrealistically believes that you should go out immediately and buy a replacement vehicle.  Some insurance companies recognize how difficult this is and will authorize a rental care for a week as a courtesy.  If the other driver’s insurance company will not provide a rental in this situation, you should check with your own auto insurance to see if you have rental reimbursement coverage that will likely cover this expense.
