Earlier this year, President Trump’s administration issued an order rescinding the Deferred Action for Childhood Arrivals (DACA) program, which extended work authorization to certain undocumented immigrants brought into the United States by their parents. Per the new rules, renewal requests were no longer considered after Oct. 5, 2017, but postal delays caused many applications to be rejected despite submitting on time. According to the immigration attorneys at Berd & Klauss, PLLC, in New York City, U.S. Citizenship and Immigration Services (USCIS) will continue accepting DACA renewal requests from individuals who provide proof their request was mailed in a timely manner.

immigration attorneyIf your application was rejected because it arrived after the deadline, the new USCIS order allows you to resubmit and enclose individualized proof that your initial paperwork was mailed well in advance. Receipts and tracking numbers from the United States Postal Service are acceptable evidence, but individuals who do not have proof can submit a letter from the USPS. If you lost your receipt or did not receive one, contact the postal service, which will review your case and provide documentation, if necessary.

USCIS has also discovered other applications arrived at the proper location before the deadline but were not processed in time. In these cases, USCIS will contact the affected applicants and ask them to resubmit their requests. However, if you do not receive a notification and believe your request arrived on time, your immigration attorney may be able to resubmit it, along with evidence the USCIS had possession of your application before the deadline.
