Workers' compensation can be a tough subject to navigate, especially when you’re dealing with the aftermath of an injury. As you pursue workers' comp or appeal a workers' comp denial, it can be helpful to understand exactly what the law covers and what it doesn’t. Below, the four areas generally covered by workers' compensation laws are explored in more detail.

A Basic Guide to Workers’ Compensation Law

Income

When you are not able to work at your present job because of a workplace injury, you still need to find a way to make ends meet. Fortunately, the law accounts for this and ensures that at least part of your income is replaced through workers' comp. The extent of your income coverage depends on the nature of your injury, your prognosis, and how long you will be out of work.

Medical

Any and all costs of care relating to your injury are paid by your employer's insurer directly to your health care providers. In the majority of cases, you will need to see a provider who is pre-approved by the workers' comp board.

Death

Death benefits are a form of financial support paid to the immediate family of one who has been killed in a workplace accident or by an occupational illness. Death benefits go toward replacing part of the income lost by the worker's death and are paid directly to the family. The deceased's spouse, minor children, and other dependents might all qualify for death benefits.

Funeral

Unfortunately, dying can be expensive, and the cost of funerals, cremations, and burials are just one reason why. If you've lost a spouse or parent in a workplace accident or because of a work-related illness, workers' comp may cover part of the funeral expenses. However, they probably won't cover all the costs associated with the funeral, so establish alternative funding options before you plan the services.
