People v. D. A. (Roch. City, 9/16)

Mr. Corletta’s 21st consecutive acquittal, reduction, or dismissal was significant; a not guilty verdict saving a client's 18-year  job as a truck driver in People v. D.A. (Roch. City, 9/16).

            In that case, the client, a truck driver, was charged with Leaving the Scene of an Accident. It was a minor scraping of two commercial vehicle’s mirrors in a tight traffic circle. Both truck drivers stopped and exchanged information as to where they worked.

            To prevent traffic from backing up, both drivers went on their way, calling the “accident” in to their dispatcher.

            Thinking that was enough, Mr. Corletta’s client continued with their duties. The client was called back to the scene when the other driver apparently changed his story, resulting in Mr. Corletta’s client being charged. The problem was that the officer did not bring the other driver to the trial, and attempted to testify for him, which was repeatedly objected to by Mr. Corletta as hearsay.

            The officer tried to have the Court believe his version of the “investigation”, which was based almost entirely upon the hearsay statements of the other driver.

            Mr. Corletta exposed this and had his client testify. The Court, finding the police officer did not sustain his burden, and Mr. Corletta’s client was credible, found Mr. Corletta’s client not guilty. This saved the client’s job, as the accident occurred while the client was on duty.
